Products and Pricing

All prices are displayed in Kuwaiti Dinar (KWD). We make every effort to ensure the accuracy of product descriptions, images, and prices. In the event of an obvious pricing error, we reserve the right to cancel the affected order before shipment and issue a full refund. We may modify prices and promotions at any time without affecting orders that have already been confirmed.

Orders and Payment

Payment is accepted via KNET, Visa, Mastercard, and Apple Pay through a secure, encrypted payment gateway. We do not view or store your card details. Orders are processed after payment confirmation, and you will receive an order confirmation via WhatsApp. We reserve the right to refuse or cancel any order in cases of suspected fraud, stock unavailability, or pricing errors, with a full refund issued to your original payment method.

Accounts and Security

Signing in to the Services uses your phone number and a one-time verification code (OTP). You are responsible for the accuracy of your account details and registered delivery address, and for keeping access to your phone number secure.

Communications

We send order-related updates (such as order confirmation and delivery notifications) via WhatsApp or email. Marketing communications are sent only with your consent, and you may opt out at any time by replying "STOP" to any marketing message.

Discount Codes and Promotions

Discount codes cannot be combined with other codes or offers in a single order unless stated otherwise. Personal reward codes are single-use, non-transferable, and valid for a limited period. We reserve the right to cancel any code that is misused or circulated outside its intended scope.

Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund & Return Policy published on this website, which forms an integral part of these Terms.

Intellectual Property

The UPPER name, logo, and all content on the Services (including text, images, and designs) are the property of UPPER and may not be used without prior written permission.

To the maximum extent permitted by applicable law, UPPER shall not be liable for any indirect or consequential damages arising from the use of the Services. Nothing in these Terms affects your statutory rights as a consumer.

Governing Law

These Terms are governed by the laws of the State of Kuwait, and the courts of Kuwait shall have jurisdiction over any dispute arising from them.
